Terms of Service

By accessing or using Ugokashi Shikibu (the "Service"), operated by JUGOYA.AI ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Ugokashi Shikibu is a service that uses AI to generate short videos from text instructions (prompts) and photos you upload.

To use the Service, you must register an account through external sign-in (OAuth / OpenID Connect), such as Google or LINE. You are responsible for maintaining the security of your account credentials. You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Service.

Certain features of the Service require a paid subscription. Payments are processed through Stripe. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless canceled before the renewal date. All fees are in Japanese Yen (JPY) unless otherwise stated. Prices are inclusive of applicable consumption tax. We may revise our fees due to changes in service content or other reasons. If we revise our fees, we will notify you of the new fees and the effective date at least 30 days in advance by email or through the Service. The revised fees will apply from the next renewal date after the notification. If you do not agree to the revised fees, you may cancel your subscription before the effective date.

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) send spam, harassing, or abusive messages; (c) attempt to gain unauthorized access to systems or data; (d) interfere with or disrupt the Service; (e) upload malicious content or code; (f) use the Service for any illegal purpose; or (g) circumvent any usage limits or restrictions.

The Service, including its design, code, and documentation, is owned by JUGOYA.AI and protected by intellectual property laws. You retain ownership of any content you submit through the Service. By using the Service, you grant us a limited license to process your content as necessary to provide the Service.

The Service uses AI models to generate content. AI-generated content may not always be accurate, complete, or appropriate. You should verify any important information independently. We do not guarantee the accuracy or reliability of AI-generated content.

The Service provides a feature to generate videos from text prompts and input images you upload (the "Video Generation Feature"). When you use the Video Generation Feature, the prompts you enter, the input images you upload, and the videos generated (collectively, "Video Content") are used for research and development of the Service aimed at improving generation quality. This includes evaluating and improving generation models and using such content to train AI models. This research use is an exception to the principle, applicable to other features of the Service, that your data is not used to train AI models, and it applies solely to the Video Generation Feature. Video Content is retained in our systems for the research and development purposes described above. By using the Video Generation Feature, you consent to the storage and research use of Video Content as described in this section.

In connection with the Video Generation Feature, you must not input, generate, or upload: (a) pornographic or otherwise sexually explicit content, or content that depicts or sexualizes minors (whether real, fictional, or AI-generated); (b) child sexual abuse material — if we become aware of such material, we will report it to the appropriate authorities (including relevant Japanese agencies and, where applicable, the U.S. National Center for Missing & Exploited Children (NCMEC)) and suspend the associated accounts; (c) content using the likeness, image, or voice of a real person without their consent, impersonation, or non-consensual intimate imagery (including deepfakes); or (d) content that violates any law or infringes the rights of any third party. If we detect content that violates this section, we may remove the content, restrict features, suspend accounts, or take other necessary action.

You are solely responsible for the content you input into the Video Generation Feature and the content generated (the "Video Content"), including ensuring its legality, non-infringement of third-party rights, and appropriateness for your intended use. The Service has no obligation to monitor Video Content and makes no warranty as to, and accepts no responsibility for, the legality, accuracy, or fitness for any particular purpose of generated Video Content. You are responsible for reviewing Video Content before using, publishing, or distributing it. To the maximum extent permitted by law, we are not liable for any damages to you or any third party arising from the creation or use of Video Content.

When you delete Video Content, it is removed from your library (hidden from view). However, for the research and development purposes described in the preceding section, the video data may be retained in our systems after deletion. You have the right to request deletion of your personal information under the Act on the Protection of Personal Information (APPI) and other applicable laws. To make such a request, please contact us at support@jugoya.ai in accordance with the procedure set out in our Privacy Policy. In addition, if you delete your account, we will delete or anonymize the Video Content attributable to that account.

The video generation feature is used by purchasing credits. Credits are consumed in proportion to the length of the generated video (6 credits for a 5-second video, 12 credits for 10 seconds, and 18 credits for 15 seconds), and the number of credits to be consumed is shown before generation. If your balance is insufficient, the video cannot be generated. Credits are granted either each billing period under a subscription plan (Lite or Basic) or through one-time add-on tickets. Subscription credits do not roll over to the next period and reset (expire) at the end of the billing period. Add-on ticket credits are valid for six (6) months from the date of purchase and expire after that period. Credits are consumed by drawing down subscription credits first, then add-on ticket credits in order of the nearest expiry date. The price and number of credits granted for each plan are displayed on the service website. The displayed price and billing currency depend on your region of access: customers in Japan are shown and charged in Japanese yen (JPY) including consumption tax (10%), with receipts and qualified invoices issued by Stripe; customers in other regions are shown and charged in US dollars (USD). We may revise prices or the number of credits granted due to changes in the service or otherwise, in which case we will provide advance notice in a manner consistent with Section 4 of these Terms. Granted credits are not refundable or convertible to cash or otherwise, except as required by law. Please see our Refund and Cancellation Policy for details on refunds.

To the maximum extent permitted by law, JUGOYA.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service at any time by deleting your account. Upon termination, your right to use the Service ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court.

We may modify these Terms from time to time. If we make material changes, we will notify you of the changes and the effective date at least 30 days in advance by email or through the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the modified Terms.
